PURPOSES AND METHODS OF PROCESSING.
The personal data you (hereinafter referred to as the “Party Concerned”) provide shall be processed as follows:
A) to respond to the requests you made in the “Contact us” area by filling out the pertinent form;
B) to send information and promotional messages (including those of a commercial nature), advertising material and/or offers of general and customised products and services, and to carry out statistical and/or marketing research and studies, using both traditional (regular mail, calls with an operator) and automated (e-mail, fax, SMS, MMS, pre-recorded telephone messages and the like) means;
C) for data profiling purposes, by creating user profiles and analysing preferences;
D) for the transmission of your data to Fraven SpaXX and/or parent companies, subsidiaries, partially owned companies or affiliates of Fraven SpaFraven Spa with registered offices in or outside of the European Union, for the purposes set forth under point 1.
Pursuant to article 24, para. 1 of Legislative Decree no. 196/2003, your consent is not required for the processing of data for the purposes set forth under letter A).
Pursuant to articles 23 and 130 of Legislative Decree no. 196/2003, your consent is required for the processing of data for the purposes set forth under letters B), C) and D).
Your personal data will be processed in hardcopy and electronic format, in compliance with the measures established for the protection of personal data, and, specifically, of the safety measures, pursuant to articles 31 – 35 and to Annex B) of the Data Protection Law, ensuring all precautionary measures are taken to guarantee data security and confidentiality.
2. MANDATORY AND OPTIONAL NATURE OF THE PROVISION OF PERSONAL DATA AND CONSEQUENCES DERIVING FROM REFUSAL TO PROVIDE SUCH DATA
For the purposes set forth under point 1, letter (A), it is necessary for you to provide your personal data. Refusal to do so on your part could prevent the company from responding to your requests.
For the additional purposes set forth under point 1, letters (B), (C) and (D), the provision of your personal data is optional.
However, refusal to provide your data could prevent the company from pursuing the purposes therein provided for.
3. SUBJECTS TO WHOM YOUR DATA MAY BE DISCLOSED. SCOPE OF COMMUNICATION AND DISCLOSURE.
Your data will be processed by companies in which we trust and which carry out tasks of a technical and organisational nature on our behalf. These companies collaborate with us directly, and act as data supervisors. The list of these companies is kept constantly up to date and is available on request by writing to the Data Controller.
In addition, based on the type of requests you address to us, your data may be disclosed to other subjects belonging to Fraven SpaFraven Spa with registered offices in or outside of the European Union
4. RIGHTS OF THE PARTY CONCERNED
In relation to the processing of the data referred to above, you will be able to exercise the rights provided for by Article 7 of Legislative Decree No. 196 of 30 June 2003, which, for your convenience, is set out below in full, by writing to the Data Controller at the address shown below.
Specifically, you have the right, at any time, to refuse your consent for the processing, by any means, of personal data regarding you, for the purposes set forth under point 1.B, or refuse your consent for the processing of your data through automated contact means.
5. CONTROLLER AND SUPERVISOR OF THE PROCESSED INFORMATION.
The Controller of the processed information is Fraven Spa , with registered office in Via Colombare 3, 37060 Nogarole Rocca, Verona (Italy)
The external supervisor in charge of personal data processing is Fraven Spa.
A detailed list of Data Supervisors may be requested by writing to the Data Controller.
Article 7 of Legislative Decree No. 196/2003. Rights of the party concerned.
1. The party concerned has the right to obtain the confirmation of the existence or otherwise of personal data that regards him/her, even if not yet registered, and to its communication in an intelligible form.
2. The party concerned has the right to obtain an indication of:
a. the origin of personal data;
b. the purposes for which such data is processed and the methods used;
c. the logic applied for processing carried out with the aid of electronic tools;
d. the identification details of the data controller, data supervisors and appointed representative, pursuant to article 5, para. 2;
e. the subjects or categories of subjects to which the personal data may be transmitted or who may learn of the data in their role as an appointed representative in the country or as supervisors or persons appointed.
3. The party concerned has the right to obtain:
a. the updating or correction of the data or, where it is in their interest, the addition of further data;
b. the cancellation, anonymisation or blocking of data processed in breach of the law, including data not required to be kept for the purposes for which said data were collected or subsequently processed;
c. a declaration stating that the operations referred to at letters a) and b) above, and their content, have been notified to those to whom the data has been transmitted or disclosed, except where this proves impossible or requires the use of means that are clearly disproportionate to the right thereby protected.
4. The party concerned has the right to refuse consent, in whole or in part, to:
a. the processing of personal data regarding them, even if pertinent to the purpose of collection, providing legitimate reasons for so doing exist;
b. the processing of personal data regarding them for the purposes of sending advertising or direct sales material or for the purposes of market research or commercial communications.
